Terms of service.
The rules governing your use of Cadence. Read them before creating an account.
1. Purpose
These terms of service ("Terms") govern access to and use of the Cadence mobile application and the cadence-music.app website, published by Max J., independent developer.
By creating an account or using the application, you accept these Terms in full.
2. Definitions
- Cadence
- The iOS mobile application and all related services enabling musical chord detection and progression building.
- User
- Any person holding an account on the application.
- Account
- The personal access space to Cadence, created via email or Sign in with Apple.
- Content
- All progressions, sessions, notes and musical data created by the user within the application.
3. Access to the service
Cadence is currently in closed TestFlight beta, accessible by invitation. The application requires an iPhone running iOS 17 or higher.
Access is free during the beta phase. Future pricing conditions will be communicated before any transition to a paid model.
4. Account creation
Account creation requires a valid email address or Sign in with Apple. You commit to providing accurate information and to maintaining the confidentiality of your credentials.
An account is strictly personal. You are responsible for any activity performed from your account.
5. Acceptable use
You commit to using Cadence in compliance with applicable laws and these Terms. The following are prohibited:
- Fraudulent use of the service or impersonation.
- Any attempt at unauthorized access to servers, third-party accounts, or data.
- Tampering, reverse engineering, decompilation of the application beyond legally authorized cases.
- Automated use (scripts, bots) not explicitly authorized.
- Any action likely to disrupt the proper functioning of the service.
6. User content
You retain full rights over the content you create in Cadence: your progressions, your sessions, your notes. These creations belong to you.
You grant Cadence a limited, non-exclusive, revocable license, strictly necessary for the operation of the service: storage, backup, restitution of your content on your devices.
Cadence does not use your content for commercial purposes, does not share it with third parties, does not analyze it to train artificial intelligence models.
7. Intellectual property
The Cadence application, its code, design, brand and editorial content remain the exclusive property of Max J. Any reproduction, modification, or unauthorized exploitation is prohibited.
The ChordNet V1.3b detection engine and certain software components use open-source components under MIT license. The list of dependencies is available on request.
8. Service availability
Cadence strives to ensure the best possible service availability. However, no obligation of continuity can be guaranteed. Interruptions may occur for maintenance, updates, technical incidents, or cases of force majeure.
During the beta phase, bugs and limitations are expected. You agree to use the application with this understanding.
9. Suspension and termination
You can delete your account at any time from the application or by request to contact@cadence-music.app. Deletion results in your content being erased within 30 days.
Cadence may suspend or terminate an account in case of breach of these Terms, after notification except in security emergencies.
10. Liability
Cadence is a composition assistance tool. Suggestions, detections, and proposals are provided for informational purposes. You remain solely responsible for your creative decisions and the use you make of the information returned by the application.
Cadence's liability cannot be engaged for indirect damages (loss of unsaved data, loss of profit, moral prejudice). To the extent permitted by law, total liability is capped at amounts actually paid during the last 12 months.
11. Personal data
The processing of personal data is described in the privacy policy, which forms an integral part of these Terms.
12. Changes
Cadence may modify these Terms for legal, technical, or product reasons. Substantial modifications are notified by email or in the application at least 30 days before they take effect. Your continued use of the service after this date constitutes acceptance.
13. Governing law and jurisdiction
These Terms are governed by French law. In case of dispute, an amicable solution will be sought as a priority. Failing that, French courts shall have jurisdiction, subject to mandatory rules applicable to consumers.
In accordance with Article L. 612-1 of the French Consumer Code, you have the right to use free consumer mediation for the amicable resolution of a dispute.
